1. General principles
We are Nidderdale Capital Limited, trading as “Drover”. Nidderdale Capital is a limited company registered in England under company number 10749364. Our registered address is The Helks, Bouthwaite, Harrogate, England, HG3 5RP in the UK.

This document sets the terms and conditions which apply when you hire a vehicle, campsite or any accessories from us. Your contract with us consists of these Terms and Conditions along with the Booking Confirmation, Hire Agreement and any other associated documents. These conditions are also applicable to all additional drivers or persons within your party accompanying the vehicle, campsite or booking.

2. Our customers
A customer is any person (or persons) who makes a booking through our website www.drover.life or through one of Drover’s representatives. A customer may be referred to henceforth as a “hirer” or “booking maker” or “you” when reading this document. The hirer is responsible for all liabilities arising from the terms and conditions set out in this document.

3. Our Vehicles
Our vehicles, or “our 4x4s” refers to any vehicle that may be listed on our website www.drover.life. The conditions on which these vehicles are made available for hire are set out in these terms and conditions.

If you have chosen to hire a vehicle from us, you will be renting the vehicle set out in your booking confirmation. If, for any reason, we are unable to rent you the vehicle set out in your booking confirmation, we will substitute it with an equivalent vehicle, and will endeavour to let you know in advance. If we cannot substitute it for an equivalent vehicle, Drover will offer a full refund for the entirety of the booking (including any vehicles, campsites & accessories that are part of the booking confirmation). If the hirer accepts the full refund, then the booking is deemed to be cancelled.

Unless we agree otherwise, we will deliver the vehicle, together with any optional accessories you have requested (subject to availability), on the date, at the time and to the Delivery Location set out in the booking confirmation.

4. Our Campsites
Our campsites are listed on our website www.drover.life and are available for private hire only. The website gives an illustration only of sites which are available for hire. The exact location of the campsite(s) booked will be made clear to the hirer prior to the hire start date. Prior to the hire start Drover will provide the hirer with a route of access to/from the campsite.

Only this route should be used to enter and exit the campsite. The boundaries of a campsite are not indefinite, but broadly are about a 15m radius from the location provided. With the exception of arriving to/from a campsite, the hirer (& any associated person) should constrain themselves to the boundaries of the campsite. The campsites are situated in rural landscapes which can contain livestock, cliffs, potholes, rivers, forestry which could present various dangers to our customers. Drover takes no responsibility for the activities undertaken by a hirer outside or on the campsite.

When reference is made to private hire, Drover can give no undertaking that privacy will be maintained due to the nature of authorised persons who interact, from time to time, on the land on which a campsite is situated. Authorised persons may include caretakers, rangers, gardeners, keepers, farmers or similar associated authorised persons with access to our property/land. Similarly, Drover can give no undertaking that privacy is maintained due to any unauthorised person who disrupts the privacy which is intended. When Drover makes reference to private camping it refers to the intention that the business will not knowingly accept two separate bookings for the same site on the same date unless permission has been given by the person(s) making the booking(s). It also refers to the same intention that Drover will seek to restrict access of authorised persons to the location of a campsite.

Please note that our campsites are only accessible by a 4×4 vehicle or by foot. If you have not chosen to hire a 4×4 vehicle from us then we expect you to access the campsite in your own 4×4 vehicle or on foot. We do NOT accept any liabilities for damage to 3rd party vehicles that are used to access our sites.

5. Our accessories
Our accessories refer to any accessory or service which may be listed on our website www.drover.life . They should not be booked without prior making a booking for either a vehicle and/or a campsite. Any additional conditions on which accessories are made available are set out in these terms and conditions.

6. Making a booking
In order to hire a vehicle, campsite or any optional accessories from Drover, you will need to make a booking on our website www.drover.life. If you have made such a booking you warrant having read these terms and conditions and entered into a contract with Drover, governed by UK law.

If you are hiring a vehicle you agree to pay the booking fee, the security deposit and comply with our insurance requirements.

If you have made a booking, you will need to provide the following information:

  • Name
  • Address
  • Mobile number
  • Email address
  • Debit or credit card details

If hiring a vehicle from us, you will need to upload copies of the following documents to our “document upload” system:

  • driving licence
  • drivers licence code
  • copy of your passport
  • bank statement (within 3 months)

If you have made a booking with Drover, you warrant to upload the required information outlined in the section.

Documents should be uploaded after the booking has been made at the “document upload” portal. If they cannot be uploaded they should be sent by email to hello@drover.life

We will use the information you have provided (as well as information from 3rd parties) to undertake various checks on your identity, credit score & driving record. Once we have accessed the details of any endorsements/penalty points on your licence, as well as confirmed your identity and creditworthiness, we will re-confirm your booking by email.

We may also re-run a licence check service again, prior to your car hire start, to ensure no changes to your driving record have taken place from the period you made the booking and the start of the hire period.

The reason we require this information is for insurance purposes, statutory “know your client” and our own internal checks on your suitability to hire a vehicle with us. We won’t be able to hire a vehicle to you unless you have passed all of these checks.

By making a booking on our website, you accept and agree to us performing such due diligence and using external service providers for efficiency. You also accept that if you do not meet the requirements set by us or our insurers, we will cancel your booking and refund your money in line with our refunds conditions.

For further information please see our privacy policy or contact us at hello@drover.life

7. The booking confirmation
The booking confirmation confirms the booking which the hirer has placed through our app or website. It contains the details of the hire, the locations, the term of hire, the associated costs and any additional conditions attached to the booking.

The booking confirmation is emailed to the hirer at the time that the booking is made on our website/app. A master record is also kept on our own internal management platform Booqable (Drover).

In the case of vehicle hire, any booking confirmation received by the hirer is subject to due diligence checks outlined above. Once due diligence has been undertaken Drover may re-issue the booking confirmation.

For the purpose of the agreement between yourself and Drover, the most recent booking confirmation (and additional correspondence) supersedes previous correspondence.

These terms apply to you as the hirer, the person paying for the hire, and any drivers added to the booking for the duration of the hire as set out in your booking confirmation. When you place a booking via our app/website, this signifies that you accept the conditions set out in these terms and conditions. The booking confirmation, together with these terms and conditions and any hire agreement, contain all the conditions which we have agreed and replaces any written or verbal agreements we have with you.

8. The hire period
Subject to any exclusions outlined in these terms and conditions, the hirer will have use of select vehicles, campsite or accessories for the period of time shown in the booking confirmation.

Before the hire end period, you (the hirer) warrant to leave any campsite(s) and return any vehicle(s) and accessories to the location outlined in the booking confirmation.

9. Amendments to the hire period
Once the hirer has completed the booking through our website/app and a booking confirmation has been sent, Drover cannot guarantee any amendments to the booking can be made. Any requests for amendments to a booking should be made to hello@drover.life. Any amendments that can be successfully made, such as changing the hire period, will result in a new booking confirmation being emailed to the hirer. This will supersede the previous booking confirmation.

If you choose to extend your hire period, any additional time will be charged at the applicable daily hire rate. If you wish to finish your hire period early, Drover will not issue and pro rata refund for your remaining hire period set out in your booking confirmation. In the case of vehicle hire, we will try our best to accommodate your request and collect the vehicle earlier. However, should this not be possible, you must bring the vehicle back for collection as set out in your booking confirmation.

10. The delivery location
If you are hiring a campsite from Drover, but not a vehicle, then we will deliver any additional accessories to the campsite in accordance with the booking confirmation.

If you have chosen to book a vehicle hire with Drover then we will deliver the vehicle and any accessories to the location(s) stated on the booking confirmation. The default location is Longside Farm, HG3 5RH. The hirer may have opted to change the delivery location to an address or train station which was offered as a delivery location on our website/app at the time or booking. In which case that address or train station will appear on the booking confirmation. The hirer/main driver of the booking must be present and have their driving licence and the card used to pay for the booking for inspection at the time the car is delivered. We will refuse to hand over the vehicle if this requirement is not met and you might be charged for the hire in full and you shall not be entitled to any refund. If you have selected a delivery location which is different to the default location, please note that our delivery drivers operate under a tight time schedule to deliver and collect our vehicles on time. There will be a 30 minute grace period. If you arrive to the delivery location later than 30 minutes after your hire start period we reserve the right to cancel your booking without refund.

11. The return location
If you are hiring a campsite from Drover, but not a vehicle, then we ask you to leave the campsite clean and tidy. Please take away all refuse. All accessories that were hired may be left at the campsite. If you leave refuse or cause damage to the campsite you accept that Drover may make a charge to your pre-authorised credit card (or any security deposit) accordingly.

If you have chosen to book a vehicle hire with Drover then please return the vehicle to the return location specified on the booking confirmation.

We will collect the vehicle and any additional accessories that you have hired at the address given by you. Please park the vehicle in a safe place. You remain responsible for the vehicle, any additional accessories and are responsible for any applicable parking charges until you hand over the keys. We inspect the vehicle with you at the collection location. We will give you a 30-minute grace period in case you are late returning the vehicle. However, if you return the vehicle after the 30-minute grace period, we reserve the right to charge you a full day’s hire fee at the applicable daily hire rate until we get the vehicle back.

12. Our insurance requirements (for vehicle hire)
You must not make a vehicle hire booking for another person. When you hire a vehicle, you handle the reservation request, payment, and hold the responsibility and liabilities outlaid in these terms and conditions.

To fulfil our insurance requirements, you warrant:

  • the booking has been made in the name of the main driver
  • the payment has been made with a credit card
  • our authorisation to pre-authorise and charge your card for the security deposit any future liabilities arising your booking
  • the card details being used match that of the main driver and their licence

You also warrant the main driver (and any additional driver):

  • holds a valid full UK, EU, AU, US, CA, NZ or SA driving licence
and their licence has been held for more than 2 years
  • is between the age of 25 & 70
  • has not been involved in more than one accident in the last 3 years
  • has not had a motoring suspension within the last 3 years
  • has no unspent motoring convictions
  • does not exceed any of the following:
  • two 3 point convictions
  • single 4 point offenses
  • single 6 point SP30, SP50 & CU80 convictions

Should these conditions not be met, we reserve the right to cancel the booking. Refunds will be issued in line with our refund terms.

If you fail to cancel or amend your booking and do not show up to collect the vehicle at the agreed delivery location and at the agreed delivery time, we reserve the right to charge you for the hire in full and you shall not be entitled to a refund.

13. The condition report (for vehicle hire)
You must inspect the vehicle and any accessories we provide before you accept delivery. If you are not satisfied with the vehicle or any accessories, or if you do not think the condition of the vehicle meets our vehicle condition report, you must notify us during the vehicle handover. In the absence of such notice, it shall be deemed that you received the vehicle and any accessories in good working order and in the condition described in the vehicle condition report.

The vehicle condition report is a file prepared by us before we deliver the vehicle to you, which sets out the condition of the vehicle. At the handover of the vehicle both you and the Drover representative sign the vehicle condition report to accept that the vehicle was delivered in good working order and in the condition stated in the vehicle condition report. You must take care of the vehicle, any accessories, the keys (or other locking devices), and any applications which can be used with the vehicle, from the time we deliver the vehicle to you until the time we collect it from you at the end of the hire period. When you return the vehicle a Drover representative will check its condition. If we have agreed to allow you to return the vehicle outside of the previously agreed time, you will remain responsible for the vehicle and its condition until our staff have checked it at the earliest opportunity. We may need to clean the vehicle before our staff can check its condition. If the vehicle is returned excessively dirty inside or outside, you might be charged up to £150 cleaning fee. You are responsible for any repair or refurbishment costs, arising from your hire period and subject to any fair wear and tear to the vehicle, and these will be deducted from the security deposit.

14. Fair wear and tear (for vehicle hire)
Fair wear and tear is ordinary wear due to reasonable use. Examples include:

  • Minor stone chips (less than 3mm in diameter and without any denting)
  • Normal wear on tyre treads (bearing in mind the distance you travelled and the length of your hire)

You are responsible for any damage to the vehicle over and above fair wear and tear and must pay our reasonable costs for bringing the vehicle back to the condition stated in the vehicle condition report. Some damage may not be apparent at the post-hire inspection, such as mechanical damage (for example, to the engine, fuel tank or drivetrain) or damage hidden by adverse light or weather conditions. If we find any such damage, we will notify you with evidence of the same. We recommend that you are present for the inspection we carry out upon your return of the vehicle, any optional accessories, the keys (or other locking devices) and any applications which can be used with the vehicle, so that any damage can be agreed. If you are not present for the inspection, we will inspect the vehicle, any optional accessories, the keys (or other locking devices) and any applications which can be used with the vehicle in your absence and, if we find any damage, we will notify you of the amount you are required to pay to bring the vehicle, any optional accessories, the keys (or other locking devices) and any applications which can be used with the vehicle, back to the condition stated in the vehicle condition report or back to the condition they were in immediately prior to the hire period. You agree that we may charge your payment card for this amount.

15. Fuel (for vehicle hire)
Unless your booking confirmation confirms otherwise, you must return the vehicle to us with a full tank of fuel, otherwise you agree to us charging you the market rate without further admin fee for refuelling it.

16. Use (of the hire vehicle)
Only the main driver, and any additional driver we have given written permission to, can drive the vehicle. Any additional driver wishing to drive the vehicle will have to meet the same criteria set out in these terms and conditions. This includes (but is not limited to) our insurance checks and “know your client” checks.

You warrant not to hire the vehicle to anyone else.

You warrant not use the vehicle or let someone else use it for any prohibited purpose.

You warrant to always lock the vehicle when you are not using it and use any immobilisation, alarm or other security device which is fitted or supplied with the vehicle.

You warrant never to leave the vehicle unoccupied with the keys in the ignition. Non-return of the keys will lead to invalidation of the theft cover, which could leave you liable to Drover for the full value of the vehicle.

You warrant not to allow unauthorised persons, young or inexperienced persons to take control of the vehicles.

You warrant to use your best endeavours to protect the vehicle against adverse weather conditions which could cause damage to the vehicle.

You warrant to use the correct fuel and fluids in the vehicle.

If the vehicle is electric or plug-in hybrid you warrant to charge the vehicle in accordance with the instructions provided.

You warrant not to sell, hire, dispose of the vehicle or any of its parts or accessories.

You warrant not give or try to give anyone the legal rights to the vehicle or transfer legal ownership.

You warrant not to let anyone work on the vehicle (including a reputable garage) without our prior written permission.

You warrant to let us know as soon as you become aware of any defect with the vehicle, or if the vehicle is stolen or involved in an accident or breakdown. Failure to notify us may result in you breaching your contract with us and you will be liable to pay any costs which we incur as a result.

You warrant not to smoke in the vehicle (or any roof tent), or carry any object or substance which, because of its condition or smell, may harm the vehicle or delay/prevent us hiring or selling it. If anyone has been smoking in the vehicle during the hire period, you could be liable for a £150 cleaning fee.

You warrant not to transport animals in any hire vehicle unless with our prior written permission.

During the hire period you must carry out the usual checks (engine oil level, tyre pressure, etc.) as would any careful user and you must respect the maintenance cycle of the vehicle as stated in the maintenance guide, if any.

You undertake to use the vehicle in a responsible manner and in particular, only for the purposes for which it is intended. For a car, this means primarily carrying passengers other than for hire and reward.

You warrant not to use the vehicle under any of the following conditions or for any of the following purposes:

  • Other than in accordance with all applicable road traffic laws and regulations.
  • Other than in accordance with these terms and conditions.
  • For any illegal purpose or in a way which would cause nuisance.
  • To carry passengers for a fee.
  • For driving lessons.
  • To tow or push any vehicle, trailer or other object (unless with permission).
  • For racing, pace-making, or to test the vehicle’s reliability, performance or speed.
  • Outside the United Kingdom, unless we have given you prior written permission and a Vehicle on Hire Certificate (VE103B).
  • If the driver is under the influence of alcohol, drugs, or any other substance (prescribed or not), which may impair the driver’s ability to drive the vehicle.
  • If it is in an unsafe, unroadworthy, or damaged condition.
  • If it is loaded beyond the manufacturer’s maximum weight recommendations.
  • To carry unsecured loads.
  • To carry more passengers than the vehicle was manufactured to legally carry.

If you do not abide by these terms and conditions, we can ask you to bring back the vehicle before the date and time we have agreed with you. To do this we will give you written notice by sending you an email or a text message (using the contact details set out in the booking confirmation). Once we have given you notice, you will no longer have our permission to be in possession of the vehicle, and will be required to return it to us immediately. If you do not do this, we may then take back the vehicle without giving you any notice. If we believe you have given us false information which was material to the decision to hire the vehicle to you, we may take back the vehicle without giving you any notice.

17. Breakdown, accident & getting “bogged in” (for vehicle hire)
If at any time a warning light is displayed, please stop the vehicle as soon as you can in a safe place and contact our breakdown insurance. You must also call a representative of Drover as soon as possible. If the vehicle cannot be repaired, where possible we will provide you with a replacement vehicle for the remainder of the hire period or, where that is not possible, refund you the charges paid for the remainder of the hire period (pro-rata). We will not charge you for the cost of recovery and/or repair if it was caused by our negligence or fault.

If you are involved in an accident, do not admit to any third party that you are responsible. If you do, you may lose the benefit of the insurance cover and be liable for the full amount of any damage. You should notify both the police and a representative of Drover straight away and describe the situation as fully as possible when you are asked to do so. You should get the names and addresses of everyone involved, including witnesses, and tell the police straight away if anyone is injured or if there is a disagreement over who is responsible. You should also make sure the vehicle is secure.

Like most car hire companies; we do not offer a recovery service. In the agreement you take responsibility for the vehicle, its safety and your own safety. It is your responsibility to assess where you are driving is safe and to drive at a slow and respectful speed. If you are driving off an unsealed road, it should be legal or you should have the landowner’s permission. If you become bogged down on land not operated by Drover, then you are responsible for the vehicle’s safe return. We suggest seeking help from the local farmer. With regards to our own campsites, sensible checks are undertaken that our defined accesses and designated campsites are safe to drive on. If you are using our campsites and get bogged down, we will try to get a local tractor to come and pull the vehicle out. However, if the vehicle becomes stuck outside of our designated campsite or its defined access route, then there is a £300 penalty charge, payable to the farmer for his time (and as a deterrent to driving irresponsibly). If the vehicle is damaged in anyway, you warrant to pay the costs for cleaning or repair.

18. In the event of theft
If the vehicle has been lost or stolen, you must tell a representative of Drover as soon as possible and confirm this in writing as soon as reasonably possible. You or any authorised drivers will also need to:

Get the names and addresses of any witnesses and give them to us.
Send us a statement in the event of a theft.
Send us any notices or other documents relating to any legal proceedings arising out of the theft or loss.
Help us and our insurers in any legal proceedings, including allowing us to take legal action in your name and defending any legal action taken against you.
Give us back all keys as soon as reasonably possible.

19. Tracking
The vehicle you have hired may be fitted with a tracking device. The tracking device will be used to ensure safe and compliant operation of the vehicle in line with these terms and conditions. If the vehicle is not available for collection at the end of the hire period on/at the agreed date, time and location, we will use the data recorded on the device to recover our vehicle. By accepting these terms and conditions, you agree that we have your consent to record and use any data we collect.

We will collect the following data using the tracking device:

  • Location
  • Distance travelled
  • Fuel level
  • Fleet management
  • Other information relating to the status, maintenance, performance and use of the vehicle

20. Personal belongings
Although we provide comprehensive insurance for the vehicle (subject to the security deposit payable by you set out in these terms and conditions, unless specified in writing otherwise), we do not provide insurance covering your personal items whilst they are in the vehicle. You are responsible for your personal belongings at all times, and for removing your personal belongings, including your data, from the vehicle at the end of the hire period. We are not responsible for any personal belongings or data left in the vehicle at the end of the hire period and we reserve the right to dispose of any unclaimed personal belongings left in the vehicle at the end of the hire period.

21. Charges
Your standard charges for the hire will be set out in your invoice and the booking confirmation. They include the hire charge based on the number of days you are hiring the vehicle, campsite or additional services,

Any additional charges will also be set out in your invoice and booking confirmation.

You will also have to pay to us:

  • Any excess resulting from the insurance in respect of damage, fire, theft, loss and 3rd parties.
  • Any charges for loss or damage to the vehicle resulting from your non-compliance with these terms and conditions, including, where applicable, an administration fee to reflect our reasonable administration costs for dealing with these matters.
  • The full cost of repairs for any damage to the vehicle or loss of the vehicle, its accessories, any camping accessories and any campsite caused by your gross negligence, serious carelessness, deliberate misuse or any other action that will invalidate any insurance cover that has been taken out, e.g. driving the vehicle illegally, driving dangerously, carelessly or through a flood. In the event you invalidate such insurance then your liability will not be limited to the excess but the full costs.
  • The full cost of repairs for any damage to the vehicle caused by you that is not covered by our insurance.
  • Any loss or damage to any vehicle accessories or optional accessories hired at time of hire, e.g. roof tent, roof tent accessories, awnings and camping equipment.
  • Any charges relating to refuelling the vehicle if the vehicle has been returned without a full tank of fuel.
  • A charge for any callouts which are your fault, e.g. losing the key to the vehicle, getting “bogged down” and general misuse of the vehicle as set out in these terms and conditions.
  • Any repairs or cleaning fees relating to your misuse of the campsite.
  • You are liable for all fees, taxes, fines and penalties incurred in connection with the use of the vehicle. There will be a £30 admin fee for any PCN’s or speeding notices obtained during the hire.
  • In addition, you are responsible for the following charges to third parties namely:
  • All charges (including legal and administrative costs) for any road-traffic offences or parking (local authority or private), congestion or toll charges, or any other offences or charges involving the vehicle, including costs from the vehicle being clamped, seized or towed away.
  • Any recovery charges arising from the Driver and Vehicle Standards Agency (DVSA), HM Revenue & Customs (HMRC), the police, or any other organisation or their agents, who have seized our vehicle while on hire to you or otherwise in your possession or control.
  • A security deposit. When you hire a vehicle with us, you will have to provide a security deposit as set out in the booking confirmation. 24h before you take delivery of the vehicle, your security deposit will be pre-authorised electronically against the same payment card that was used to make the booking. Although the money will not be taken from your account, it will not be available to you until the end of the hire period. If your deposit fails, your booking will be cancelled, and you will be charged for the first day’s hire. At the end of the hire period, the security deposit will be released to your credit card or refunded to your debit card provided there is no new damage to, or any other issue affecting, the vehicle which was not present immediately prior to the start of the hire period. If there is new damage to, or any other issue affecting, the vehicle when the vehicle is returned, this will be communicated clearly to you and the fair market-rate cost for repairing the vehicle will be passed on to you up to the maximum of your security deposit amount. If you have purchased Vehicle Hire Excess Insurance and return the vehicle with new damage, the above procedure will still apply. You will then be able to file a claim to the Vehicle Hire Excess Insurance for the amount taken from the deposit to reduce your excess to £0. There are no administration fees for dealing with such damage to, or other issues affecting, the vehicle. Please note that it may take up to 10 working days for the deposit monies to be available, depending on your bank or card provider.

You accept and permit that should such charges arise, that Drover will have the right to charge any pre-authorised credit card for the monies or deduct the amount from any security deposit before refunding it to you.

How can I pay for my rental?
Payment is required by credit card or debit card. Cash, cheque, and pre-paid cards are not accepted. We accept payment by most major credit/debit card providers, including Visa, MasterCard and American Express. Third parties may not pay for a rental and the credit or debit card presented at the start of the hire must always be in the name of the main driver. We will charge you interest on any overdue payments at the rate of 4% a year above the base lending rate as published by Barclays Bank PLC from time to time. Interest will be added every day, from the due date until the date of payment, to any amount you do not pay us on time.

22. Credit & Debit Card Payments
We can only accept payment by Credit or Debit Card Payments.  When you make a payment for the Hire Charge and/or Security Deposit you are also authorising us to charge the same card for any damage excess charges, fines or other charges as set out in these terms and conditions.

Refunds

If you need to cancel your booking prior to the hire you accept that we will refund your charges as follows:

  • The security deposit in full
  • With reference to the booking fee
    • 100% if within 3 months off the hire start date
    • 50% if within 1 month of the hire start date
    • 25% if within 2 weeks of the hire start date
    • 0% during the hire period

If you cancel your booking during the hire period, you accept we will be unable to refund any booking fee and we will process your security deposit in accordance with these terms and conditions.

It is possible that Drover will need to cancel your booking because you have not met our insurance requirements or due to unforeseen issues (for example mechanical breakdown or similar). In which case we will refund 100% of your booking fee and release any security deposit.

Prior to your hire start period, it is possible that Drover will need to cancel your booking because you have not met our insurance requirements or due to unforeseen issues at our end. In which case we will refund 100% of your booking fee and release any security deposit.

23. Our responsibilities
We will deliver the vehicle to you containing a full tank of fuel, in a roadworthy state and suitable for you to use at the start of the hire period. We will have maintained the vehicle to at least the manufacturer’s recommended standard.

We are also responsible for any loss you suffer as a result of us breaching the contract between us, or if we could have predicted your loss at the time the contract was entered into. We are not responsible for any indirect losses which occur as a side effect of the main loss and which we or you could not have predicted, such as loss of profits or loss of opportunity (for example, not being able to go to a business meeting or catching a flight).

24. Limitation of liability
You are responsible for your own safety and the safety of others. You are also responsible for your own personal property. Drover does not accept any liability in respect of damage or loss that may occur to your personal property during the hire period. We recommend you have adequate travel insurance in place to cover such eventualities.

25. Data protection
By entering into this contract, you agree that we can process and store your personal information in connection with these terms and conditions. For further information on how we process your personal data, please see our privacy policy.

It is the vehicle user’s choice and responsibility to use and remove data via the infotainment options available in each vehicle. We cannot guarantee the privacy or confidentiality of such information, and you must wipe it before you return the vehicle to us. If you do not do this, the next users of the vehicle will be able to access this information.

You also accept that by sending us any feedback or photography that we may choose to publish such information on our website or social media accounts. Similarly you accept that we may publish any feedback you have left with 3rd parties, which is publicly available to us.

26. Ending the contract
If you are an individual, we may end the contract between us if we find out that your belongings have been taken away from you to pay off your debts, or a receiving order has been made against you. We may also end the contract between us if you do not comply with the main terms of these terms and conditions.

If you are a company, we may end the contract between us if you go into liquidation, you call a meeting of creditors, we find out that your goods have been taken away from you until you pay off your debts, or you do not comply with these terms and conditions. If we end the contract between us it will not affect our right to receive any amount you owe us. We can also claim reasonable costs from you if you do not meet the main conditions of these terms and conditions. We can repossess the vehicle and charge you a reasonable amount for doing so.

27. Disputes and the law
Should a dispute arise, Leaseurope has published a code of conduct for the car rental industry. You may obtain a copy at the following address: www.leaseurope.org. We aim to deal with all disputes fairly and calmly. If, between us, we cannot deal with a disagreement, either you or we may take the matter to the BVRLA’s conciliation service.

These terms and conditions are governed by the laws of England and Wales. Any disagreement may also be settled in the courts of England and Wales.
